The Game is making an effort to get a $10 million sexual abuse lawsuit against him thrown out of court on the basis that he was never served the case papers in the first place, according to Bossip.

Priscilla Rainey, Game's co-star in the reality show She's Got Game, sued Game for $10 million last August after claiming the Cali rapper sexually abused her on several occasions in one night during the month of May. The two had gone to a local bar for an after-hours date in Illinois after filming the show when Rainey claimed that Game harassed her multiple times, shoving his hand up her dress and forcefully rubbing her vagina and buttocks. Rainey says she never gave the rapper permission to do so and felt degraded by the unwanted touching.

On Feb. 1 a judge ruled against Game on the basis that he simply did not reply to the lawsuit in the first place.

But Game is now saying that he didn't respond because Rainey never served the papers to him properly. In court documents obtained by Bossip, Rainey allegedly said she tried to serve Game the papers over 40 times, but the Compton rapper said he never got them because he's often traveling for shows. His lawyers also say that Rainey's attempts to serve Game the papers at shows and appearances don't count because he has constant security surrounding him to fend off members of the public.

According to Bossip, Game says he's never tried to dodge the papers, and if Rainey had done her homework she would have known to catch him either at the studio or the gym.

Game is asking the judge to toss out the default judgment against him. A hearing is set for later today (Feb. 26).
